Dear Mrs. Whelan Breen,
The following is the Kilrush Chamber of Commerce's Casual Trading Submission. We look forward to presenting the findings of our recent Casual Trading Survey and our submission at the May meeting of Kilrush Town Council.
Re: Kilrush Chamber of Commerce - Casual Trading Submission Summary
Kilrush Town Council to take on board survey findings and comments.
Visit other towns with active markets, e.g. Ennis, Limerick, and Ballycotton, Co. Cork.
Develop back of Town Hall/The Square.
Promote local & organic produce, local arts & crafts, horticulture, antiques & charity stalls.
Designate Friday/Saturday mornings, 9 a.m. -2 p.m.
What are the insurance implications?
Health & Safety aspects.
Liaise with the Mid- Western Health Board (Ms Fiona Healy) where applicable.
Parking availability on Horse Fair Days, more spaces needed for customers. Trader's vehicles-refer to Casual Trading Bye- Laws 1995 section 7 D-J.
When adopted the Casual Trading Bye-Laws must be strictly enforced.
Survey findings show need for proper Market for our Market Town.
Horse Fair Days -Survey shows majority decrease in business. WHY?
No Parking.
Health & Safety - restricted movement of customers' vehicles.
Suggest move Horse Fair Day to Park de Plouzane and provide Free parking throughout Kilrush on Horse Fair Days. (4 per year.)
Kilrush Town Council review every 6 months newly adopted Bye-Laws.

Survey:
160 Surveys delivered and 72 returned - 45%
Carried out between 12th - 17th March, 2003.
Survey Findings:
Question 1: Casual Trading on a weekly basis. Is this a good thing for Kilrush?
Range: (5 Agree to 1 Disagree):- 5: 47.9%; 4: 24.7%; 3: 17.8%; 2: 1.4%; 1: 8.2%
Question 2: Casual Trading on Traditional Horse Fairs?
Range - (5 Agree to 1 Disagree): - 5: 62.8%; 4: 20.0%; 3: 5.7%; 2: 7.1%; 1: 4.3%
Question 3: Does Casual Trading increase or decrease your turnover?
Range -( +% Increase to -% Decrease):- Increase: + 31.4%; Decrease: -45.7%
No Difference: 4.3% and No comment: 18.6%
Question 4: Would you prefer to see Country Markets e.g. local homemade produce and crafts in designated area e.g. Back of Town Hall?
Range: (5 Agree to 1 Disagree): - 5: 31.1%; 4: 14.9%; 3: 8.1%; 2: 1.4%; 1: 4.1%
Question 5: Would you agree/disagree with a defined/controlled/managed Trading Activity to include Licence, Time, Type of products sold?

“Using The Square/Back of Town Hall an excellent idea.”
“Market Town brings more people to town.”
“Kilrush is a Market Town with No Market.”
“If we are to have Casual Trading, let's have Quality.”
“Kilrush has always been noted as a market type town. However, it would be better served by reliable traders, not fly by night traveller type traders, full licensing of traders for Insurance/Taxes should be a requirement.”
“Anything which brings more people to town must be a good thing. Too much bureaucracy will deter traders.”
“If controlled properly with quantity and quality - it will work for everybody.”
“Reasonable fee per licence per stall.”
“Agree in principle, in the style of the markets in Limerick and Galway.”
“A farmers' market on Fridays.”
"Businesses in Frances Street get completely blocked in, local business pay rates, no consideration for our customers parking. Easy to sell cheap when you don't have big overheads e.g. rates. It is the ordinary business that keep the town running and employ local people.”
“Liaise with the Health Board, and stalls should be supplied by Council and attempts should be made not to clash with existing business.”
“Back of Town Hall.”
“Be discriminating with licences, i.e. not 4 or 5 of the same stalls and not junk. If work got out that Kilrush had a clean varied market, it would be good for the whole town.”

Casual Trading as defined by Casual Trading Act 1995, draft copy available form Kilrush Town Council
“Casual Trader” means any person or his nominated agent, authorised to carry out casual trading pursuant to The Casual Trading Act 1995 and these Bye-Laws.
“Casual Trading Area” means the land standing designated in these Bye- Laws made under Section 6 of the Act as an area where casual trading may be carried on.
“Casual Trading” means selling of goods at a place (including a public road) to which the public have access as a right or any other place that is a Casual Trading Area defined by the Act.
